110% FAIR PRICE GUARANTEE

Terms and Conditions

The Baby Superstore (TBS) fair price guarantee is made subject to the following terms and conditions by each TBS store which sells a product ("Relevant Product") to a person ("Customer") during the period 1st July 2006 and ending on 30th June 2008.

If, within 30 days after the actual date of purchase by the Customer of the Relevant Product, the Customer delivers to the store a genuine copy of an advertisement broadcast on commercial radio, telecast on any commercial television or published in a daily newspaper (other than the classified section) by a local competitor to the TBS store and that advertisement occured within a 30 day period after the Relevant Purchase from TBS and the advertisement offers or offered for unconditional sale to the public a product identical to the Relevant Product, during the term, for an unconditional advertised cash price ("Competitor Price") which is less than the price paid by the Customer to the TBS store for the Relevant Product after all allowances, rebates and discounts, then the store will pay the Customer an equivalent to 110% of the difference between the competitor price and TBS price by way of a TBS Gift Voucher.

The Customer cannot accept the The Baby Superstore 110% Fair Price Guarantee: (a) more than once in relation to a Relevant Purchase; or (b) if the competitor price is conditional, or a price determined after the allowance of any amount for, or is part of a promotion involving, financing, installation, delivery, rebates, cash back offer, free or bonus offer, trade discount, stock clearance or any limited quantity promotion; or (c) the competitor is not local (determined to be having a physical presence within a 30km radius for country and regional stores or three suburbs apart for city stores). In all instances, any offer over the internet is not deemed to be made by a local competitor unless that business has a physical presence within the site criteria mentioned and that same offer is made via their shop. Our online store guarantee must include all shipping and handling charges and be available for immediate delivery.
